Terms and Conditions

The VENDOR is COTSWOLD TRADING LIMITED (T/A EQUISUPPLIES). GOODS refers to goods and services.

  1. Unless otherwise agreed in writing these conditions constitute the only conditions upon which the vendor is willing to supply goods and/or services.
  2. TERMS OF PAYMENT
    Unless otherwise agreed in writing all goods must be paid for within 30 days from invoice date.
  3. PRICES AND QUOTATIONS
    The prices quoted are current only on the date of quotation and shall be subject to any variation to allow for any increase in the costs that are incurred by the vendor coming into effect between the date of the quotation and the date of delivery or completion of the contract without notice unless specifically stated otherwise on the quotation.

    We reserve the right to charge interest on any overdue account not paid according to our Terms of Payment. This will be at a rate of 3% per month or part month overdue. Interest will be added to the statements and any interest due and unpaid will be left again as an outstanding overdue balance. Where interest accrues in this way, any payment received will be applied first in payment of the interest due and only secondly in reduction of the outstanding balance.

    We reserve the right to add to any overdue account the costs incurred by us in collecting the account through a third party acting on our behalf.

    Any complaint regarding goods must be notified to us in writing within 7 days of receipt.

    Any claim by the buyer or his agents for compensation for defective goods shall be limited to the actual cost of those goods or services. No liability will be accepted in any way for any consequential loss or damage resulting from those goods.
  4. RETENTION OF TITLE
    Goods supplied by ourselves shall be at the buyers risk immediately on receipt of the goods by the buyer or his agent, and should therefore be insured at their full value. Title of goods supplied will only pass to the buyer upon payment in full to the vendor. Where payment is overdue according to our terms of payment, or in the event of the buyer becoming insolvent or having a receiver or liquidator appointed to administer his affairs prior to the payment in full being received, we reserve the absolute and sole right to treat the purchase agreement as null and void and to repossess the goods supplied.
  5. SUBSIDIARY CLAUSES
    a) Time shall not be the essence of the contract.
    b) The Vendor shall not be liable in the event of non-fulfilment of a contract owing to an Act of God, war, strike, lockouts, fire or any incident of any nature beyond the direct control of the vendor.
    c) We reserve the right to alter or amend these Terms and Conditions from time to time. Where an alteration is made, a new copy of the Terms and Conditions will be sent which will then become the current Terms and Conditions and become legally binding.
    d) All charges are subject to VAT at the current rate.
    e) Should any clause contained in these Terms and Conditions be held to be invalid, such invalidity will not affect the validity of the remaining clauses.
    f) These Terms and Conditions shall be subject to and be construed in accordance with English Law.
